RENTALS
Rentals made thorough our website are for accommodations only. Payment will be accepted by check or credit card, due at time of booking. Charges will appear from "Destination Vacations" on your credit card statement.

ADDITIONAL CHARGES
Maid service will be provided a minimum of every other day as part of the lease for Villa La Estancia. Lessee(s) understands that the Lessor renting this villa is a private operator and in no way affiliated with Villa La Estancia Cabo San Lucas or The Villa Group, and that any services or amenities included with this reservation are limited to those stated in this agreement. Additional services and/or amenities not included with this rental but available and provided by Villa La Estancia to Lessee(s), shall be paid by Lessee(s) directly to Villa La Estancia. These include but are not limited to local and long distance calls, restaurant, spa and other incidental charges, additional maid service, certain amenities, additional linens above and beyond those provided at check-in, etc. A valid credit card will be required to check in. 
 

RESPONSIBILITY
Lessee accepts that, as a private residence, any issues that may arise within the villa are ultimately under the control of, and thus the responsibility of, the owner of that villa. Lessee(s) also understands that in order to facilitate an acceptable and timely resolution of any issues, they must be reported immediately and directly to the Lessor for appropriate action and/or resolution.

DAMAGE AND SERVICES DEPOSIT
Lessee(s) are responsible for damage to the property beyond normal wear and tear.  Lessee(s) agree to provide a valid credit card, (M/C or Visa) to Lessor, which may only be charged for damage above and beyond normal wear and tear.  Lessor must provide Lessee(s) an itemized description of any charges.  Lessor will destroy the credit card information 14 days following the completion of the rental.

No smoking is permitted within the Villa.

OCCUPANCY
The total number of occupants shall not exceed the number of guests listed under the leased Premises, as indicated above.  No pets of any kind are permitted. The Lessee certifies that at least one of the occupants is 25 years of age or older.

QUIET AND LAWFUL POSSESSION AND USE OF PREMISES
The Lessee(s) agree that they and their families, parties and guests shall not abuse the Premises in any way and shall leave same in the same condition as when taken.  Lessee(s) agree that they and their families, parties and guests shall:

1. Respect the rights of other occupants of Villa La Estancia, 
2. Follow the rules, regulation and Code of Conduct (see below) of Villa La Estancia, and
3. Abide by all other laws and rules applicable to occupants of Villa La Estancia.

INSURANCE/INDEMNIFICATION
The Parties acknowledge that the Lessor, agents, and property owner shall not be responsible for any loss or damage caused to the Lessee’s personal property located on the Premises and recommends that the Lessee(s) obtain their own travel insurance.  Lessor, agents, and property owner shall not be responsible for any personal injury or property loss by Lessee(s), their families, parties or guests, expenses, claims, or injury, direct or indirect, caused or incurred before, during or after the party's stay in the Villa. Lessee(s) agree to indemnify and hold Lessor, agents, and property owner harmless for any claims arising from a violation of this agreement or of any third party claims.

CANCELLATION
Reservations canceled within 90 days of arrival are subject to the following terms:
All payments made will be returned only if the Villa can be re-rented at the same rate for the same time period.  A $250 processing fee will apply to a cancellation in all cases. During holiday periods (holidays to be defined at the sole discretion of DestinationCabo.com), reservations are refundable at any time only if the Villas can be re-rented at the same rate for the same time period. This refund will be subject to a $500 processing fee. Due to the non-refundable nature of this rental, Lessor recommends the purchase of trip cancellation insurance.

EVICTION
In the event the Lessee(s) breaches any of the terms of this Agreement the Lessor reserves the right to evict the Lessee(s) without notice and without set off.

INSPECTION
The Lessor reserves the right to inspect the premises at any time.

LAW
This Agreement will be governed by the laws of the United States and the State of Oregon, without reference to rules governing choice of laws. Any action relating to this Agreement must be brought in the federal or state courts located in Oregon and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of law or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to the benefit of, and enforceable against the parties and their respective successors and assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. You acknowledge that you have agreed to be bound by the terms and conditions of this Agreement whether electronically or otherwise, you further acknowledge that you have received, understand and agree to this Agreement.

    VILLA LA ESTANCIA CODE OF CONDUCT

Dear Guest:

Your reservation requires you to observe the resorts "code of conduct" during your stay at Villa La Estancia. We would like for you to take a moment of your valuable vacation time to read Villa La Estancia`s Code of Conduct which has been established to assure that all
guests have the most joyful and relaxing vacation while in residence.

Check in and checkout times:

  •  Check in time 4:00 PM / Check out time 11:00 AM. All room keys issued upon check in must be returned upon departure. Keys not returned may be subject to a charge.

Secure your valuables:

  • For your convenience, there is a safety deposit box located in a closet of your villa. Management will not be responsible for any loss of money, jewelry, cellular phones, cameras, ipods or any other valuables from your room or public areas of the property. It is your responsibility to make sure all your doors and windows are locked every time you leave your villa.

Pool and Beach regulations

  • The pool is open for your enjoyment from 8:00 AM to 9:00 PM, the pool bar until 6:00 PM and Jacuzzis until 10:00 PM. Bringing glassware, ice chests, food or beverage items to these areas at any time is not permitted. Ice chests are allowed in the beach area only.
  • Pool and beach lounge chairs – maximum of 2 chairs can be reserved per guest for one hour only beginning at 8:00 AM. In the event this time is exceeded, our staff will remove your personal belongings and they will be kept at the towel stand. In addition, staff will remove personal belongings on any lounge chair before 8:00 AM. Guests accept responsibility for any items lost from lounge chairs.
  • To ensure all guests have the opportunity to enjoy the pool, pool bar, Jacuzzis and resort grounds, please refrain from excessive noise, roughhousing and throwing any objects (e.g., balls, Frisbees, toys, etc.) or playing any games in these areas. Oversized pool floats are not allowed in the pool. Management reserves the right to limit the amount of pool floats allowed in the pool at times of high occupancy.
  • Personal audio devices are permitted with head phones only. No speakers of any kind can be used in the public areas.
  • Visitors are welcome inside your villa and at our Restaurants only and must be registered at the front desk. Pool facilities are exclusively for registered guests. The number of registered guests and visitors permitted will depend on each villa’s capacity.
  • Villa La Estancia will not accept liability for services provided by external companies. All beaches in Mexico are federal property and a very high degree of caution should always be exercised. Activities such as parasailing, wave runners, scuba diving and snorkeling carry an inherent risk. Please be careful.

General Rules:

  • Villa La Estancia is a "Smoke Free" resort. All common areas open to the public including pools, hot tubs, lobby and walk ways within Villa La Estancia are non smoking areas according to Mexican Law. Smoking areas have been designated next to the resort property and on the beach.
  • Guests assume full responsibility for any and all damages caused by themselves and their guests for the duration of occupancy and accept charges in relation to room inventory items damaged or lost, discovered before or subsequent to their departure.
  • The resort will not be responsible for any guest injuries from any cause whatsoever. Guests are responsible for their own safety at all times. Walk with caution on dark areas or wet surfaces.
  • Please refrain from playing loud noise and music or having loud conversations on villa terraces at any time, but in particular, after 10:00 PM to allow quite time. Visitors who are on property after 10:00 PM or who - in the opinion of the management - are causing a disturbance or excessive noise, shall be required to leave the property.
  • Guests are not permitted to drape any articles over balcony rails (e.g., towels, bathing suits, etc.).
  • Guests are responsible for the behavior of their children and should ensure that they do not disturb other guests or cause damage to the property.
  • Pets are not allowed on property.
